<p><P>PROBLEM TO BE SOLVED: To provide a method and an apparatus for preventing an overflow of a video packet, minimizing an effect of a compression efficiency, and maintaining an image quality of the video. <P>SOLUTION: A dynamic AC prediction technology is implemented in a data partition mode to disable the AC prediction automatically in order to encode a macro block in the next packet when the packet overflow occurs. When the overflow does not occur, the AC prediction is kept in an enabled state and the compression efficiency is maintained. In a preferred embodiment, when the macro block is encoded in the current packet, it is decided first whether it causes the packet overflow or not. If so, a new packet is initiated and the macro block is encoded as a first macro block to it without accompanying the AC prediction.
