PROBLEM TO BE SOLVED: To effectively and accurately set up a liquid surface level so as to separate the liquid surface of a working liquid at a designated position from an upper surface position of a workpiece. SOLUTION: In an electric discharge machine 1 for discharge-processing the workpiece W while overflowing the working liquid from a processing container 6 movable up and down, the electric discharge machine 1 comprises an optical sensor 20 having a floodlight 21 for floodlighting a light beam and a light-receiver 22 for receiving the light beam of the floodlight 21, and a setting device 30 including an optical sensor 20 for outputting detection signal detecting whether or not the workpiece W is existed on an optical path on the basis of light-receiving data of the light beam on the light-receiver 22, a workpiece upper surface position detection means for detecting an upper surface position W' of the workpiece W on the basis of the detection signal outputted from the optical sensor 20, and a liquid surface level setting means for setting the liquid surface level of the working liquid by moving up and down the processing container 6 from the origin position set up at a designated level so as to separate the liquid surface of the working liquid from the upper surface position W' of the detected workpiece W.
