An apparatus and a method of assigning resources of a mobile communication system are provided to check whether an MCS level assigned per each mobile terminal in a mobile communication system is suitable for channel quality of a current wireless channel and dynamically change an MCS level if it is not suitable. A mobile communication system comprises a plurality of mobile terminals and a base station(200). A plurality of mobile terminals provides channel quality information of a wireless channel receiving a data frame and a response message by checking error of the data frame. A base station assigns an MCS level corresponding to the channel quality information to transmit a data frame through a corresponding wireless channel. The base station determines adequacy of the assigned MCS level according to a response message about the data frame to change the MCS level corresponding to the channel quality information.
