A method for determining the transmission path of a packet based on allowable delay time and a channel condition of the transmitted packet and a network device using the same are provided to determine a relay node relaying the packet between a source node and a destination node. A first relay node(501) transmitting a packet received from a source node transmits an RTS(Request To Send) message to nodes(503). Each node receiving the RTS message estimates a channel gain(507). The node in which the presumed channel gain is greater than the fixed setting value transmits CTS(Clear To Send) message including the presumed channel gain value. If the node transmitting the CTS message is one, the node transmitting the CTS message is determined as the second relaying node.
