PROBLEM TO BE SOLVED: To provide a fixing device and an image forming device, capable of preventing a fixing device member from being thermally deteriorated or hot-set off, by maintaining a temperature of a non-paper-sheet-passing area at a prescribed temperature or less, and capable of maximizing a through-put. SOLUTION: This fixing device/image forming device includes the first resistance heating element 401 and the second resistance heating element 402, in a heater 105, and has a CPU for controlling electric power supplied to the resistance heating elements 401, 402 to bring a temperature detected by a thermistor 101a into a prescribed fixing temperature, and a CPU for changing an electrification ratio in the resistance heating elements 401, 402 by two or more of fixing conditions, a threshold value temperature detected by a thermistor 101b is changed in response to the electrification ratio in the resistance heating elements 401, 402, and based on an upper limit temperature of the non-paper-sheet-passing area of the heater 105 or a fixing belt, and the number of recording paper sheets fixing-processed per a unit time is changed when a temperature detected by the thermistor 101b gets to the prescribed threshold value temperature.
