The present invention relates to a construction method of an expansion joint apparatus to prevent a water leak and a crack and, more specifically, relates to a construction method of an expansion joint apparatus to prevent a water leak and a crack which prevents damage to a concrete by increasing a tensile strength of the concrete to fixate an expansion joint apparatus on a structure, and prevents rainwater or the like infiltrated from an asphalt concrete paving unit provided on both sides of the expansion joint apparatus from being penetrated into the concrete; thus preventing a strength of the concrete from being reduced. To achieve this, the present invention comprises: an expansion joint apparatus installation process installing an expansion joint apparatus on an installation unit formed in a structure; and a concrete depositing process depositing concrete on the installation unit. After the concrete depositing process, the present invention further comprises: a paving unit cutting process forming a cutting groove by cutting the asphalt concrete paving unit formed on a side portion of a concrete layer formed in the concrete depositing process; and a sealant injection process injecting a sealant into the cutting groove.
