The device (400) has an access (1) for the inlet of water, and a pipe (2) connected to the access for the evacuation of air entering the access when the water is above an overflow level (N1). The pipe includes a valve (5) intended to be controlled to be in an open position for passage of water above the overflow level, and a closed position to prevent passage of water. A drain system (40) is arranged to discharge the water through another pipe (4) in the closed position of the valve when the water exceeds another overflow level (N2) above the former level. An independent claim is also included for a swimming pool.
