Disclosed are a device for preventing overcharging of a battery and a battery. The device includes holders interposed in gaps between stacked battery cells; an installation space formed between an adjacent holder and an outline of the holder; and a cutting module. The cutting module is inserted in the installation space. An inserted end portion of the cutting module is located between adjacent cells in the installation space and is fixated on the holder. On the exposed other end portion of the cutting module, a cutter blade is formed to face a gap between a lead tap and a bus bar which are attached to each other. One end portion and the other end portion of the cutting module are joined by multiple hinges. When a side of the cell is inflated, the side of the inflated cell presses the hinges; the hinges are spread; the other end portion of the cutting module is extended to the outside; and the cutting module cuts attachment between the lead tab and the bus bar. |
