PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor configured to improve cleaning performance and to prevent density unevenness from occurring on an image formed, an image forming apparatus and an image forming method.SOLUTION: An electrophotographic photoreceptor is configured by forming a photosensitive layer on a conductive support and forming a surface layer on the photosensitive layer. The surface layer is formed by containing an organic resin fine particle and a metal oxide fine particle in a curable resin obtained by polymerization-reacting a chemical compound having two or more radical polymerizable functional groups. The organic resin fine particle is formed of a resin containing a constitutional unit derived from at least one kind of melamine and benzoguanamine, and has a number average primary particle diameter of 0.01-3.00 μm.
