本发明提供一种可形成具有各种形状的积层结构的微细的(例如孔径、点径、空间宽度、及线宽等的尺寸为500nm以下的)图案的图案形成方法、由该图案形成方法所制造的图案、以及使用其的蚀刻方法、电子元件的制造方法及电子元件，所述图案形成方法依次包括：(i)于基板上依次进行下述步骤(i-1)、下述步骤(i-2)及下述步骤(i-3)，而形成第1负型图案的步骤，(i-1)使用感光化射线性或感放射线性树脂组成物(1)于所述基板上形成第1膜的步骤，所述感光化射线性或感放射线性树脂组成物(1)含有因酸的作用而导致极性增大、且对于包含有机溶剂的显影液的溶解性减少的第1树脂，(i-2)对所述第1膜进行曝光的步骤，(i-3)使用包含有机溶剂的显影液对所述经曝光的第1膜进行显影的步骤；(iii)于所述基板的未形成有所述第1负型图案的膜部的区域中，埋设含有第2树脂的树脂组成物(2)来形成下层的步骤；(iv)使用感光化射线性或感放射线性树脂组成物(3)于所述下层上形成上层的步骤，所述感光化射线性或感放射线性树脂组成物(3)含有因酸的作用而导致极性增大、且对于包含有机溶剂的显影液的溶解性减少的第3树脂；(v)对所述上层进行曝光的步骤；(vi)使用包含有机溶剂的显影液对所述上层进行显影，而于所述第1负型图案的表面所形成的面上形成第2负型图案的步骤；以及(vii)将所述下层的一部分去除的步骤。; (iii) a step of forming a lower layer by embedding a resin composition (2) including a second resin in an area of the substrate on which no membrane portion of the first negative pattern is formed; (iv) a step of forming an upper layer on the lower layer by using an actinic ray-sensitive or radiation-sensitive resin composition (3), wherein the actinic ray-sensitive or radiation-sensitive resin composition (3) contains a third resin in which a polarity thereof is increased due to an effect of acid and a solubility to a developer including an organic solvent is decreased; (v) a step of exposing the upper layer; (vi) a step of developing the upper layer by using the developer including the organic solvent, thereby forming a second negative pattern on a surface formed by a surface of the first negative pattern; and (vii) a step of removing a part of the lower layer.
