PROBLEM TO BE SOLVED: To determine whether an operator is an eligible person at the moment when the operator is actually operating a device, and to prevent becoming a dangerous state.SOLUTION: An operation eligible person determining device includes: a three-dimensional light measuring means which captures pose of a monitoring object operating a device in a visual field, and measures three-dimensional coordinate of each part in the visual field; a motion recognition means to recognize a predetermined ineligible behavior from a test result of the three-dimensional light measuring means; and an ineligible correspondence means to execute predetermined processing according to the ineligible behavior when the motion recognition means has recognized the ineligible behavior.
