<p>The present invention relates to an encoding device and an encoding method, and a decoding device and a decoding method, by which the amount of encoding of an encoded stream when information relating to a depth image is being included into the encoded stream can be reduced. A DPS encoder establishes depth image information, which is information relating to a depth image, as a DPS different from the sequence parameter set and the picture parameter set. A slice encoder section encodes the depth image, generating encoded data. The slice encoder section transmits an encoded stream containing the DPS and the encoded data.
