The present invention relates to an apparatus and a method for controlling congestion in a network apparatus, which can minimize traffic drop by regularly distributing traffic for each user according to a position of network equipment and a congestion type and dropping the excessively inputted traffic based on the distributed traffic. To this end, the present invention provides a method and an apparatus checking the congestion type based on the position of the network apparatus; identifying a network connection section with high possibility of a congestion occurrence according to the congestion type and setting a congestion threshold bandwidth for determining the congestion occurrence; identifying a user needed in regularly distributing the traffic when the congestion occurs based on the congestion threshold bandwidth; and regularly distributing the traffic for the user identified based on the congestion threshold bandwidth and then dropping the traffic flowing into the user more than the regularly distributed traffic to avoid the congestion.
