PROBLEM TO BE SOLVED: To provide a fixing device which has excellent in heat insulating performance and eliminates the deterioration of temperature detection accuracy of an abnormal temperature detection member and an image forming device having the same. SOLUTION: A fixing device 5 comprises: a heat insulating cover 61 and an upper frame 56 which are disposed at a part of an outer peripheral surface of a fixing roller 18 at a predetermined interval and interrupts the outflow of heat to the outside; and a thermostat 71 having a bimetal 75 which detects a surface temperature of the fixing roller 18 and is disposed close to an outer peripheral surface of the fixing roller 18 to supply or interrupt power to a heater 43 based on the surface temperature detected. The thermostat 71 has a case part 72, which accommodates the bimetal 75, fitted and held into hole portions 61a and 56a formed in the heat insulating cover 61 and the upper frame 56.
