Disclosed are a wireless communication apparatus and a method for using common access point (AP) priorly, and an apparatus and a method for operating a wireless communication apparatus as a mobile access point. A wireless signal detecting unit detects available wireless signals for near filed communication of a frequency band used by the wireless communication apparatus. An AP determination unit determines a common AP as a service AP for providing network access of the wireless communication apparatus when the common AP is included in APs which transmit the available wireless signals detected by the wireless signal detecting unit. The AP determination unit determines a mobile AP for providing the network access to other apparatuses through a mobile AP function or a tethering function as the service AP when the common AP is not included in the APs which transmit the available wireless signals detected by the wireless signal detecting unit. A data communication unit transmits and receives data by connecting to the near filed communication network through the service AP. According to the present invention, the energy consumption of the mobile terminal, which provides the Internet to the wireless communication apparatus through a mobile example or the tethering function, is minimized.
