Suggested are an interlayer video encoding method for performing illumination compensation according to the image characteristic of the block of different layer images and an apparatus thereof, a video decoding method and an apparatus thereof. A first layer image is restored based on encoding information obtained from a first layer bit stream. To restore a second layer block determined by a preset partition type and prediction mode, it is determined whether illumination compensation is performed or not to the second layer block determined by using the first layer reference block corresponding to the second layer block among the restored layer images. A second layer restoration block is generated by using the first layer reference block and an interlayer prediction information obtained from the second layer bit stream. The illumination of the second layer restoration block is determined according to whether the illumination compensation is performed or not. Therefore, an interlayer video encoding method of generating a second layer image is suggested.
