PROBLEM TO BE SOLVED: To provide a seal device and a rotary machine capable of preventing fluid leakage from between a head member and a casing by regulating the displacement of the head member without increasing the casing in size.SOLUTION: The rotary machine comprises: a cylindrical casing 5; a rotation shaft 2 and an impeller 3 that are disposed inside the casing 5; a stationary member 6 inserted into the interior of the casing 5 and forming a fluid passage in between the rotation shaft 2 and the impeller 3; a head member 50 disposed at the end of the stationary member 6 in an axial direction and regulating the movement of the stationary member 6 toward the end in the axial direction of the stationary member 6; and a regulating member 53 supported to an inner peripheral surface 5a of the casing 5 and regulating the displacement of the head member 50 toward the end thereof in the axial direction by an abutment on the head member 50 in the axial direction. The head member 50 comprises: a regulated part 55 regulated by the regulating member 53; and a part 59 to be pressed with an outer diameter smaller than that of the regulated part 55 disposed closer than the regulated part 55 to the axial direction center side to face the stationary member 6.
