A data storage apparatus and method using a scalable encoder are provided to prevent the loss of data being stored by dividing and storing data in a core layer and an enhanced layer. A data storage apparatus comprises a scalable encoder(407) which encodes inputted data in a scalable coding method, a memory unit(409) which divides and stores the scalable coded data in a core layer and an enhanced layer, and a controller(401) controlling the memory unit based on the use amount and residual capacity of the memory unit and the comparison result between the residual capacity and the threshold value according to the storage method designation or set standards of user. |
