PURPOSE: An overload controlling apparatus capable of preventing failure caused by an overload of an interlocking system, a method thereof and a multimedia message service system using the same are provided to control the transmission of a multimedia message of a multimedia message transmission server, thereby preventing the occurrence of failure caused by an overload of a multimedia message service system. CONSTITUTION: In case a present state is determined as an overload state, an overload determination unit(220) converts a present mode into an overload control mode. In case the present mode is converted into an overload control mode, an overload control unit(230) temporarily stores the predetermined temporary storage ratio of a multimedia message among the multimedia messages requested to be transmitted to a multimedia transmission server, without transmitting to a receiving mobile terminal. If the overload control mode is canceled, the overload control unit temporarily transmits the stored multimedia messages to the receiving mobile terminal at a predetermined reprocessing speed.
