The present invention relates to a data communication apparatus based on a vehicle network and a method thereof. The present invention provides a data communication apparatus based on a vehicle network, capable of optimally transmitting and receiving data even if a memory capacity of a first communication device is different from a memory capacity of a second communication device when transmitting data based on the vehicle network. To this end, the data communication apparatus based on a vehicle network according to the present invention includes: a transmission data processor to read transmission data stored in a transmission memory; a data transmitter to transmit the transmission data read by the transmission data processor to another communication device connected to the vehicle network; a data receiver to receive data from the other communication device connected to the vehicle network; a reception data processor to record the data (hereinafter referred to as′received data′) received from the data receiver, in a reception memory; and a controller to control a reading rate of the transmission data processor according to a comparison result of a capacity (hereinafter referred to as′first capacity′) of the transmission memory with a capacity (hereinafter referred to as′second capacity′) of a reception memory of the other communication device, and to control a recording rate of the reception data processor according to a comparison result of a capacity (hereinafter referred to as′third capacity′) of the reception memory with a capacity (hereinafter referred to as′fourth capacity′) of a transmission memory of the other communication device.
