Disclosed are a method of setting a motion vector list and an apparatus using the same. A method of setting a motion vector list and an apparatus using the same may include the following steps of: determining whether a first or second motion vector exists in a first spatial candidate prediction group according to a sequential determination procedure; and setting the first or second motion vector obtained by the sequential determination procedure as a candidate prediction motion vector. Thus, the time elapsed in the process of coding and/or decoding may be reduced and complexity may be decreased by limiting the number of scalings when the candidate prediction motion vector is scanned.
