Disclosed is a cutting pick apparatus, wherein an elastic element (5) is provided in a pick holder (1), a force is transferred between a cutting pick (2) and the elastic element (5) via a separation sleeve (4), a pick sleeve (3) is provided between the cutting pick (2) and the pick holder (1), the distance between the pick sleeve (3) and a cutting pick head (21) is less than the maximum of the elastic element capable of being compressed such that the collapsing of the elastic element is avoided, and the cutting pick (2) is able to be in rigid contact with the pick sleeve (3) so as to reduce the wearing of the pick holder (1). Further disclosed is a mining machinery having the present apparatus. The apparatus is able to absorb the impact during operation and able to avoid the machine being damaged by the accumulated impacts such that the relatively large vibration produced by equipment in an overall operation can be inhibited. When the cutting load is relatively large, the elastic element is able to absorb the energy such that 10% to 30% of the absorbed energy can be converted into an active power to counteract the accumulated impacts or to output power to break the rocks. The elastic element specially made is reliable and durable, and is convenient to assemble or disassemble. The pick sleeve is able to prevent the pick holder from being worn out effectively.
