PURPOSE: A device for determining a signal violation at an intersection using the information of passing state and a determining method thereof are provided to determine a signal violation by comparing an integral driving time with the total value of an offset time, which is interval time between green light duration time at the intersection where an accident occurred, and a green light duration time. CONSTITUTION: A collecting unit(110) collects the passing state information of a vehicle at an intersection. A calculating unit(120) calculates the total driving time between the intersection where an accident took place and the intersection before the same. A determining unit(130) determines a signal violation of the vehicle at the intersection where the accident took place after determining whether the total driving time is within a predetermined range.
