The present invention relates to image compression technology and, more specifically, to a TS packet generating device of the image compression technology and a TS packet generating method thereof. The TS packet generating method in a data transmitting apparatus according to an embodiment of the present invention comprises the steps of: receiving a PES packet; and simultaneously generating at least two TS packets among a plurality of TS packets corresponding to the PES packet as a result of analysis of the PES packet. The TS packet generating method according to the embodiment thereof can generate the TS packets more rapidly by generating at least two TS packets by TS packet generating function at once.
