The present invention relates to a device for detecting failures in switching elements capable of detecting failures in switching elements by changing duties of a pulse-width modulation wave to make on-time and off-time of the switching elements different from each other and measuring voltage differences due to a resistance value and a method thereof. According to one exemplary embodiment of the present invention, the device for detecting failures in switching elements which detects failures in a plurality of switching elements using a three-phase motor driving unit of a smart booster used in a vehicle brake system includes: a switching control unit which controls each of the switching elements to be on or off in order to make duties different from each other; a resistor unit which is made up of resistors each of which is connected to each switching element; a voltage measuring unit which measures a voltage at the central point on which three-phase motors are connected to each other; and a failure detecting unit which detects failures in the switching elements using the voltage measured by the voltage measuring unit.
