The present invention relates to a data terminal upgrade device and method. The device comprises a dialing module, a protocol module, a DHCP server module, a router module, an IP processing module, an upgrade module and a web server module. The dialing module completes a dialing flow; the upgrade module obtains a private IP address from the DHCP server module, sends to a version server a request message for detecting whether there is a new version through the router module and the protocol module, and if yes, downloads the new version from the version server and writes same in the flash of a data terminal, and the data terminal automatically restarts to complete the upgrade. The present invention enables an upgrade procedure, a web server access procedure and a PC online procedure of a data terminal under a Win8 operating system to be respectively independent, reduces the correlation between the upgrade procedure of the data terminal and the PC operating system, and can achieve a driver-free function through Microsoft Win8 logo authentication. |
