PROBLEM TO BE SOLVED: To solve the problem of an NAL unit header in the conventional method in which, even where the value of nal_ref_flag is uniquely determined according to the value of nal_unit_type, bits are assigned to each of nal_ref_flag and nal_unit_type, resulting in inefficient design.SOLUTION: A moving image prediction encoding device comprises input means for entering a plurality of images composing a moving image, and encoding means for encoding the image by either an intra-picture prediction method or an inter-picture prediction method to generate compressed image data and then packetizing the generated data together with packet header information, characterized in that the packet header information includes a picture type, and that the encoding means determines the picture type so as to uniquely indicate whether encoded picture data is used for reference when other pictures are decoded.
