PROBLEM TO BE SOLVED: To provide an image encoding and decoding apparatus capable of preventing decrease of image quality of IPCM blocks.SOLUTION: The image encoding and decoding apparatus performs: a filter step (S204) in which a filtered data is generated by performing a filter processing on plural blocks neighboring to each other with respect to an image by using a pixel value included in each of the plural blocks; determination steps (S201 and S202) to determine whether each of the plural blocks is an IPCM (Intra Pulse Code Modulation) block or a non-IPCM block; and a reconstitution step (S205) to generate a reconstitution image which has a part of the filtered data as a pixel value of the non-IPCM block and a pixel value of an IPCM block which has not been subjected to the filter processing as a pixel value of the IPCM block.
