PURPOSE: An IP based contents providing system using background buffering, a contents receiving device, and a method thereof are provided to play wanted contents through a background buffering mode during the buffering time of IP based contents based on the intend of a user. CONSTITUTION: A receiving part (210) receives IP based first contents of from a server. An input part (240) receives a message that determines whether to use a background buffering mode. When the input part receives an input to use the background buffering mode, a controlling part (230) buffers the first contents received through the receiving part and plays second contents stored in advance. An output part (250) outputs the second contents being played.
