PURPOSE: Scalable video encoding method and device, scalable video decoding method and device are provided to offer a video encoding method by determining a scalable encoding mode by encoding a lower layer image. CONSTITUTION: A lower layer encoding unit (1410) encodes a lower layer image based on encoding units with a lower layer tree structure. The encoding units with a tree structure include encoding units in which encoding units having divided in the divided encoding units having the maximum encoding unit of an image hierarchically divided. An upper layer encoding unit (1420) determines a scalable encoding mode for scalable-encoding with reference to the lower layer image. The upper layer encoding unit prediction-encodes the upper layer image with reference to encoding information of the lower layer image. An output unit (1430) outputs the encoding information of the lower layer image and scalable encoding mode of the upper layer image.
