PURPOSE: A device for confirming the operating system of a host device in a mobile terminal and a method thereof are provided to prevent the execution of the application in a host device by converting a descriptor according to the operating system of the host device. CONSTITUTION: A connecting port (202) receives a descriptor request from a host device. An analyzing part (206) analyzes the descriptor request and provides the analyzed result to an operating system determining part (208). The operating system determining part determines the operating system of the host device using the information of received from the analyzing part. If the descriptor request for obtaining data size is confirmed, the operating system determining part determines the first use of the host device. If the descriptor request for obtaining data size is not confirmed, the operating system determining part determines the use of a second operating system of the host device.
