PROBLEM TO BE SOLVED: To solve the problem in which encoding efficiency is not improved due to deterioration in prediction accuracy of a prediction motion vector.SOLUTION: A merge motion information candidate list construction unit 162 generates a merge motion information candidate list as a list of merge motion information candidates using a spatial merge motion information candidate and a temporal merge motion information candidate. A second merge motion information candidate replenishment unit 165 generates a new merge motion information candidate that, when a reference index indicates an available reference picture, includes the reference index, and when the reference index does not indicate an available reference picture, includes a predetermined reference index, together with a motion vector having a preset size and direction, and adds it to the merge motion information candidate list. A merge motion information selection unit 231 selects one merge motion information candidate from the merge motion information candidate list to which the new merge motion information candidate is added on the basis of a decoded specification index, and derives the selected one merge motion information candidate as motion information of a prediction block to be decoded. |
