PURPOSE: A data packet transmitting and receiving apparatus and a method thereof are provided to reduce zero padding data, and to improve the error correcting capability. CONSTITUTION: A receiving device includes a source block interpreter (112), an FEC encoder (113), and a receiver. The receiver receives a received data (111) formed of a source block and transmits to the source block interpreter. The source block interpreter classifies the received data formed o the source block into source symbols applied with restoring blocks. The FEC encoder FEC encodes the source symbols for restoring source packets (114). The source block interpreter uses signaling information (115) received together or separately with the received data, for restoring loss data.
