PROBLEM TO BE SOLVED: To provide an exhaust emission control apparatus in which particulates in a particulate filter (PF) can be removed appropriately by determining whether the inside of the PF is in a frozen state or a water containing state, and to provide an exhaust emission control method.SOLUTION: An exhaust emission control apparatus including a PF for capturing particulates includes: a differential pressure sensor for measuring a differential pressure value at front and rear of the PF; a temperature sensor for measuring a PF exhaust gas temperature; and a control section electrically connected to the differential pressure sensor and the temperature sensor, respectively. When starting an internal combustion engine, the control section performs PF internal state determination processing for determining whether the inside of the PF is in a frozen state or a water containing state on the basis of the differential pressure value and the PF exhaust gas temperature. While it is determined by the PF internal state determination processing that the inside of the PF is in the frozen state or the water containing state, the control section controls not to perform processing for forcibly oxidizing particulates in the PF.
