PURPOSE: Contents distribution device, method and recording medium recording a program for implementing the same using peer-to-peer (P2P) are provided to minimize the cost for forming a contents distribution network by forming the contents distribution network without installing a cache server. CONSTITUTION: A peer decision unit (210) receives peer information including location and resources information of a peer willing to be a main or a backup peer for contents and time period which the peer willing to be operated as a main or a backup peer for the contents and decides the main and backup peer by contents, region and time period based on the peer information. A contents distribution unit (230) distributes the contents to the main and backup peer. A program providing unit (220) provides a duplication protection program to the main and backup peer before distributing the contents to the main and backup peer.
