<p><P>PROBLEM TO BE SOLVED: To provide a communication apparatus for efficiently generating retransmission data without increasing a processing load on a CPU, and to provide a data communication system, data communication method and control program. <P>SOLUTION: The communication apparatus 1 includes: a first data processor for generating a non-divided packet; a second data processor for dividing the non-divided packet generated by the first data processor to generate a plurality of divided packets; and a retransmission request processing means 12 for determining, in the case that retransmission of at least one of the plurality of divided packets is requested from a communication partner, a method for generating a retransmission packet smaller than the non-divided packet in accordance with the retransmission-requested divided packet.
