PURPOSE: A video encoding/decoding apparatus capable of using the predictability of the intra prediction mode and a method thereof are provided to improve the compression performance by minimizing the amount of bit for encoding the information about the intra prediction mode when predicting the video by using he intra prediction in the video encoding or decoding. CONSTITUTION: When the information about the intra prediction mode of the current block extracted from a mode information extractor (1210) indicates a first encoding mode, a prediction mode determiner (1220) configures the intra prediction mode candidates by the peripheral block information of the current block and decides one of the intra prediction mode candidates as the intra prediction mode of the current block. When the mode information indicates a second encoding mode and the prediction mode identification information is included in the mode information, a prediction mode extractor (1230) decides the intra prediction mode of the current block. A decoding unit (1240) restores the residual block from the encoding data. The decoding unit predicts and restores the current block according to the determined intra prediction mode.
