PURPOSE: A hand over execution apparatus in a wireless local area network (LAN) communication system and a method thereof are provided to minimize the delay time which is required for the hand over execution decision making. CONSTITUTION: When a control unit detects the generation of a scan trigger event, a transmission unit (915) transmits a VS Action scan trigger report (STA) IE message to a serving access point (AP) which indicates that the scan trigger event has generated. A receiving unit (911) receives the VS Action scan control IE message from the serving AP which indicates a scan parameter related to a control scan operation of the STA. The transmission unit broadcasts a probe requesting message to the serving AP and the adjacent Aps through the channels in correspondence to the VS Action scan control IE message.
