PURPOSE: A phosphor and a light emitting diode having the same are provided to prevent deterioration in high temperature by mixing a nitride-based yellow fluorescent substance and a silicate-based orange fluorescent substance. CONSTITUTION: A nitride-based yellow fluorescent substance(177) is excited by the light generated from compound semiconductor. The nitride-based yellow fluorescent substance has a major peak in a range of 480-520nm. The silicate-based orange fluorescent substance(175) is excited by the light generated from the compound semiconductor. The silicate-based orange fluorescent substance has a major peak in a range of 520-600nm. The rate of the silicate-based orange fluorescent substance to the nitride-based yellow fluorescent substance is 1:0-0.5:0.5.
