PURPOSE: A device for determining a bit rate of audio content and a method thereof are provided to accurately divide the audio content, which is compressed by a fixing bit rate, among audio content which is compressed by a variable bit rate and the fixing bit rate. CONSTITUTION: An audio content determination unit(110) determines whether or not a frame size for audio content is the same through sampling rate information of the audio content. A first bit rate determination unit(120) determines kinds of a bit rate of the audio content by skipping the number of temporal frames for the audio content having the same frame size which is received to the audio content determination unit. A second bit rate determination unit(130) determines the kinds of the bit rate of the audio content by skipping the number of temporal frame units for the audio content having a frame size which is not the same.
