PURPOSE: A device for obtaining a code image in a portable terminal and a method thereof are provided to recognize the code image by analyzing the color of text data, the color of the code image, and the color of an overlap area, thereby accurately recognizing only the code image which is overlapped on the text data. CONSTITUTION: An image recognition unit(102) obtains a screen which includes a code image. A code analysis unit(104) confirms pixel color information for the obtained screen. When a lot of color information is in the pixel color information, the code analysis unit recognizes the code image by removing temporary color information. The code image includes at least one of a QR(Quick Response) code and a barcode.
