PURPOSE: A motion candidate list generating method and an encoding device using the same are provided to increase the efficiency of an image encoding and decoding by changing and applying an index sequence for setting the motion candidates according to the shape of a PU(Prediction Unit) block or the positions of the surrounding blocks. CONSTITUTION: An encoding device adds merge motion candidates from the surrounding blocks of a current PU block to a merge candidate list(S310). The device adds merge motion candidates from a block of a reference picture corresponding to the current PU block to the merge candidate list(S320). After the composition of the merge candidate list, the device changes a combination index sequence according to the shape of the PU block or the positions of the surrounding blocks(S330,S340).
