PURPOSE: A cooperative spectrum sensing device and a method thereof are provided to accurately calculate the probability that a channel is used by a priority user. CONSTITUTION: A reception unit(231) receives the channel usage state information of a channel applied to a priority user from two or more next users. A detecting unit(232) analyzes the distribution of channel usage state information for a predetermined period of time in the two or more next users. The detecting unit detects one or more malignant users from the two or more next users. A determination unit(233) determines whether the channel is used by the priority user using channel usage state information except for the channel state information received from the one or more malignant users.
