PURPOSE: A user terminal for controlling a data call while executing a voice call and a method thereof are provided to control a data call while executing a voice call, thereby preventing problems such as a sound quality fault, call disconnection, etc. CONSTITUTION: A modem unit(110) processes a signal received through an antenna for communication with other nodes. The modem unit provides the processed signal to a call control unit. The modem unit processes the signal received from the call control unit. The modem unit transmits the processed signal through the antenna. When a data call is requested from a network while executing a voice call or generation of a data call request is informed by the call control unit, the modem unit protects the voice call by blocking the data call request and the data call.
