<P>PROBLEM TO BE SOLVED: To provide a nonaqueous electrolyte battery offering excellent output characteristics, and a battery pack comprising the nonaqueous electrolyte battery. <P>SOLUTION: The nonaqueous electrolyte battery comprises a nonaqueous electrolytic solution, a positive electrode 3, a negative electrode 4, and a separator 5. The nonaqueous electrolytic solution contains an asymmetric sulfone compound represented by the formula 1: R<SB POS="POST">1</SB>-SO<SB POS="POST">2</SB>-R<SB POS="POST">2</SB>, where R<SB POS="POST">1</SB>≠R<SB POS="POST">2</SB>, and R<SB POS="POST">1</SB>and R<SB POS="POST">2</SB>each represent a C1-C10 alkyl group; and a symmetric sulfone compound represented by the formula 2: R<SB POS="POST">3</SB>-SO<SB POS="POST">2</SB>-R<SB POS="POST">3</SB>, where R<SB POS="POST">3</SB>represents a C1-C6 alkyl group. The positive electrode contains a complex oxide represented by Li<SB POS="POST">1-x</SB>Mn<SB POS="POST">1.5-y</SB>Ni<SB POS="POST">0.5-z</SB>M<SB POS="POST">y+z</SB>O<SB POS="POST">4</SB>, where 0≤x≤1, 0≤y+z≤0.15, and M represents at least one kind of element selected from Mg, Al, Ti, Fe, Co, Ni, Cu, Zn, Ga, Nb, Sn, Zr, and Ta.
