PURPOSE: An oil separating apparatus and an oil separating vessel are provided to efficiently separate crude oil from polluted seawater and fresh water by generating magnetic force on the basis of superconductivity. CONSTITUTION: An oil separating apparatus includes a container(10), liquid helium, a superconductive magnet coil, and liquid nitrogen. A hollow part is arranged in the container, and oil polluted sweater or fresh water flows through the hollow part. The container has a tubular peripheral part. A triple layered tubular space is formed in the internal space of the tubular peripheral part. The intermediate layer of the tubular space is filled with liquid helium. The superconductive magnet coil is positioned at the middle of the liquid helium. The upper and lower layers of the tubular space are filled with liquid nitrogen.
