<P>PROBLEM TO BE SOLVED: To provide a light emitting device which inhibits the occurence of peeling of a case and a sealing member from an element mounting substrate, and to provide a manufacturing method of the light emitting device. <P>SOLUTION: A light emitting device 1 includes: a resin package 2 having a case 20 opening at the light extraction side and a sealing member 21 filling the case 20; a light emitting element 4 sealed by the sealing member 21 of the resin package 2; and an element mounting substrate 3 where the light emitting element 4 is mounted and the resin package 2 is formed on the element mounting surface 3a side.
