<P>PROBLEM TO BE SOLVED: To provide a communication device, a communication method, and a communication program which can control a deterioration in measuring accuracy due to the interrelation of measurement conditions of a band. <P>SOLUTION: If a necessary range Rm satisfying a prescribed condition exceeds a search range Rs determined based on a measurement result of an available band (S25: YES), a plurality of small search sections are set such that the search sections cover the whole band included in the search range Rs (S29). At this time, at least one small search section is set such that the band included in the section partly overlaps with bands included in adjacent other small search sections. Data is transmitted to a receiver sequentially by respective transmission bands included in the set small search sections via a network.
