PROBLEM TO BE SOLVED: To improve encoding efficiency by selecting an appropriate direct mode with respect to a slice capable of using one of spatial and temporal direct modes.

SOLUTION: A moving image encoder includes: a determination part for determining whether or not a predetermined condition is satisfied by using a motion vector of a processing object block in a p-slice and a motion vector of an adjacent block of the processing object block; a count part for counting the number of processing object blocks determined to satisfy the predetermined condition; a selection part for selecting one of a temporal direct mode and a spatial direct mode by using the number of the counted processing object blocks; and an encoding part for encoding the processing object blocks of a B-slice on and after the p-slice by using the selected temporal direct mode or spatial direct mode.
