<P>PROBLEM TO BE SOLVED: To provide a solid state image element capable of providing a high quality output image by reducing a difference of a smear ratio in a pixel portion. <P>SOLUTION: The solid state image element has a micro lens 16 and a color filter 17 that selects wavelengths of red, green and blue and includes an optical waveguide structure (optical waveguide 13 ...) that allows incident light after transmitting through the color filter 17 to propagate to a pixel opening part by using a material having a refractive index larger than that of a peripheral portion. The opening diameter of the optical waveguide 13 gets smaller from the pixel center toward the periphery portion. In particular, the opening diameter d<SB POS="POST">G1</SB>at the central portion is larger than the opening diameter d<SB POS="POST">G2</SB>at the outer periphery.
